Smoker indicted in store cash grab

A grand jury has indicted a Marion man on charges that he swiped cash from a convenience store after determining the smokes he wanted to buy were too expensive.
On May 11, a grand jury returned 41 true bills of indictment. A grand jury meets behind closed doors to consider if enough evidence is present for a case to be heard in Superior Court.
The panel indicted Kevin Christopher Lail, 25, of Diamond Cove Drive on two counts of obtaining a controlled substance by forgery or fraud and one count each of common law robbery, felonious breaking and entering, larceny, injury to personal property and possession of a firearm by a felon.
At approximately 11 p.m. on Saturday, April 4, a suspect entered Rocket Food Mart on Rutherford Road and asked the clerk for a pack of cigarettes. When told the price, the man stated that he didn't have enough money and went to get his wallet from the car. When he returned, he asked the employee if the store sold loose cigarettes, and she told him they were 25 cents apiece. The man asked for some, and, when the clerk rang up the sale, the suspect reached across the counter, grabbed a stack of $20 bills and a stack of $10 bills from the register and fled, according to a report by Officer E.R. Rodriguez of the Marion Police Department.
The man was caught on the store's surveillance video. Officers viewed the tape and identified the suspect as Lail.
His other indictments stem from separate incidents.
The grand jury also indicted the following people on May 11:
-- Michael Bennett Bryant, 21, of Montford Cove Road, Marion, one count each of felonious breaking and entering, larceny and injury to real property.
-- Brandon Dale, 25, of Crestwood Drive, Marion, one count each of possession of cocaine and felonious larceny.
-- Allen Eugene Edwards, 41, of Tatertown Loop, Nebo, one count of trafficking opium.
-- Crystal Lynn Elliott of Green Meadow Lane, Marion, one count of aiding and abetting a sex offender.
-- Jonathan Brooks Floyd, 31, of Randolph Road, Marion, one count of felonious larceny.
-- James Rollins Glover Jr., 23, of Ridley Street, Marion, one count each of possession of stolen goods and possession of a stolen firearm.
-- Brian Keith Greene, 37, of Waycaster Road, Marion, one count of felonious larceny.
-- Jordan Huffman, 19, of Hoppy Tom Hollow, Nebo, one count each of felonious breaking and entering and felonious larceny.
-- Brian Eugene Kelly, 36, of Landis Lane, Nebo, three counts of possession of an immediate precursor chemical used to manufacture methamphetamine.
-- Santiago Leyva, 35, of Lytle Mountain Road, Marion, one count of taking indecent liberties with a child.
-- Michael Jennings Morgan, 40, of Old Toms Creek Road, Marion, two counts of identity theft and one count of special ID fraud in committing a felony.
-- Randy Patton, 52, of Muddy Creek Road, Nebo, one count each of possession with intent to sell and deliver a Schedule IV controlled substance, possession with intent to sell and deliver a Schedule II controlled substance, possession of cocaine, possession with intent to sell and deliver marijuana and maintaining a place to keep a controlled substance.
-- Robert Hezekiah Patton, 20, of Forest Park Road, Marion, one count of possession of cocaine.
-- Chadwick Lynn Prince, 29, of Green Meadow Lane, Marion, one count of sex offender going on premises of a child.
-- Richard Anthony Smith, 45, of Hitt Park, Marion, two counts of attempted first-degree sex offense of a child and one count of taking indecent liberties with a child.
-- Derrick Cecil White, 22, of Deer Park Resort, Nebo, four counts of obtaining property by false pretense and one count each of uttering a forged instrument and financial card theft.
