Pair will face trial in robbery

A pair accused of robbing a man of his motorcycle at knifepoint will face their charges in McDowell County Superior Court.
On Sept. 21, a grand jury returned 74 true bills of indictment. A grand jury meets behind closed doors to consider if enough evidence is present for a case to be heard in Superior Court.
The panel indicted 31-year-old Tommy Lynn Burleson of Faith Baptist Church Road in Marion on one count each of simple assault, assault on a female, injury to personal property and robbery with a dangerous weapon.
They also indicted 24-year-old Michael Ray Pope of Faith Baptist Church Road on one count of robbery with a dangerous weapon.
On the night of Saturday, Aug. 8, McDowell County sheriff's deputies responded to a possible assault on Lake James Road.
The victim, Jason Bartlett, told the officers that he pulled his motorcycle from Marina Drive onto Lake James Road and was met by two men standing on the pavement flagging him down, according to Sheriff's Office reports.
Once Bartlett stopped his bike – a 1983 Honda valued at $800 – the two suspects brandished knives, held them to his throat and demanded the motorcycle, the reports stated.
The grand jury also indicted the following people on Sept. 21:
-- Mark James Anderson, 44, of Pinnacle Church Road, Nebo, one count each of driving while impaired, habitual impaired driving, driving while license revoked and failure to wear a seat belt.
-- Denise Donel Andrews, 29, of Newland, four counts of obtaining property by false pretense.
-- Johnny Ray Burleson, 28, of Valley Road, Marion, one count each of breaking and entering a motor vehicle and misdemeanor larceny.
-- Brad Joseph Franklin, 24, of Whitner Drive, Marion, one count of trafficking opium.
-- Tammy Westall Gibbs, 32, of Logan Street, Old Fort, one count of obtaining property by false pretense.
-- Nicholas Charles Hall, 17, of Tatertown Loop, Nebo, three counts each of breaking and entering a place of worship and conspiracy to commit breaking and entering a place of worship and one count of larceny of a motor vehicle.
-- Johnny Daniel Harrison Jr., 37, of Sherwood Forest Drive, Nebo, one count of possession of a firearm by a felon.
-- Angel David Honeycutt, 18, of Greenlee Road, Marion, two counts each of felonious breaking and entering, larceny after breaking and entering and possession of stolen goods and one count of injury to real property.
-- Cody Allen Ivers, 18, of Deerhound Drive, Marion, one count each of attempted breaking and entering a building and attempted breaking and entering a motor vehicle.
-- William Ray Lewis, 82, of Riverview Drive, Marion, one count each of assault by strangulation and first-degree burglary.
-- Michael James Martin, 30, of Rolands Chapel Road, Nebo, one count each of larceny of a motor vehicle, obtaining property by false pretense, injury to real property, first-degree trespassing, possession of stolen goods and misdemeanor larceny.
-- Michael Aaron McCraw, 17, of Archway Drive, Nebo, three counts of conspiracy to commit breaking and entering a place of worship, two counts of breaking and entering a place of worship and one count each of injury to personal property and larceny of a motor vehicle.
-- Sherry McGee, 35, of Spring Street, Old Fort, one count each of felony possession of methamphetamine and possession with intent to sell and deliver methamphetamine.
-- Ricky J. McPeters, 27, of Great Hill Drive, Marion, one count of possession of a firearm by a felon.
-- Robert Hezekiah Patton, 21, of Crestwood Drive, Marion, two counts of possession with intent to sell and deliver a Schedule II controlled substance and one count of possession with intent to sell and deliver a Schedule IV controlled substance.
-- Derrick Roberts, 18, of Old Catawba River Road, Old Fort, one count each of second-degree burglary, larceny after breaking and entering, possession of stolen goods, injury to personal property and injury to real property.
-- Jacob Daylen Ross, 34, of U.S. 221 South, Marion, one count each of obtaining property by false pretense, misdemeanor larceny, possession of a firearm by a felon, felonious breaking and entering, larceny of a firearm, possession of stolen goods and larceny of a motor vehicle.
-- Melvin Russell of Black Mountain, one count each of breaking and entering a motor vehicle, larceny of a motor vehicle, possession of a stolen motor vehicle and larceny of a firearm.
-- James Dale Shehan Jr., 19, of Seagle Street, Marion, one count each of attempted breaking and entering a building and attempted breaking and entering a motor vehicle.
-- Don Winslow Tate, 55, of U.S. 70 East, Nebo, one count each of cruelty to animals, possession with intent to sell and deliver marijuana and maintaining a place to keep a controlled substance.
-- Johnny Whiting of Mackey Creek Road, Marion, one count each of conversion by tenant and injury to real property.
