Truck strikes, kills pedestrian

Driver not charged in fatal accident

No charges are being filed against the Tennessee pickup truck driver who hit and killed a pedestrian early Sunday morning.
At 3:38 a.m., Juan Antonia De La Cruz Cordova, 31, of Kids Way in Marion was either crossing the road or walking in the road on U.S. 221 North near the intersection of U.S. 221 North Business, when he was struck by a 1996 Ford pickup truck driven south by James Arthur Woodward Jr., 54, of Unicoi, Tenn., according to Sgt. D.B. Brown of the N.C. Highway Patrol.
The sergeant stated that it was dark outside and Cordova was wearing dark clothing. Woodward tried to swerve to miss the pedestrian but was unsuccessful, said Brown.
Cordova died at the scene.
Trooper R.W. Monosso, who is investigating the fatality, is not charging Woodward, Brown stated.
This was the second fatal wreck of the year in McDowell.
