Two plead guilty to assaulting man

One of the two people who assaulted a man and stole from him will spend time in lockup and the other one already has.

            Darlene Nicole Hughes, 21, of Ellis Street in Marion recently pleaded guilty in McDowell County Superior Court to felony larceny from a person, obtaining property by false pretense and assault inflicting serious injury. Judge Laura J. “Suzy” Bridges handed her an eight- to 10-month suspended sentence and placed her on supervised probation for 36 months. Hughes was ordered to serve 90 days in prison, spend nine months on intensive supervised probation and pay court costs, restitution of $2,795 to the victim in the case and reimbursement of $825 for a court-appointed attorney.

            Also, James Kenneth Clark, 23, of Ellis Street in Marion pleaded guilty to assault inflicting serious injury and larceny from a person. On the assault charge, the judge sentenced him to 150 days in jail and gave him credit for that amount of time spent in pretrial confinement. In relation to the larceny charge, he was given a 10- to 12-month suspended sentence and was placed on supervised probation for 36 months. He was ordered to spend nine months on intensive supervised probation and pay court costs, restitution of $2,795 to the victim in the case and reimbursement of $375 for a court-appointed attorney.

            Investigative Sgt. Rick Gutierrez of the Marion Police Department spoke with Lewis Benge, 78, of Ellis Street on March 5 at Valdese Hospital. Benge was admitted as a patient there following an assault on March 2.

            The victim had been living with Hughes and her mother on Ellis Street, according to Gutierrez.

            On the evening of March 2, Hughes and Clark beat Benge, said the detective, and stole his wallet and debit card. Hughes withdrew $300 from Benge’s bank account, Gutierrez stated.

            The following defendants also appeared Aug. 9 to 13 in McDowell County Superior Court:

            -- Angela Marie Brown, 46, of Greensboro pleaded guilty to possession with intent to sell and deliver a Schedule III controlled substance. The judge handed her a six- to eight-month suspended sentence and placed her on supervised probation for 36 months. She must spend nine months on intensive supervised probation and pay court costs, restitution of $600 for a state lab fee and reimbursement of $300 for a court-appointed attorney.

            -- Johnny Douglas Davis III, 28, of Lincoln Avenue in Marion pleaded guilty to obtaining property by false pretense and misdemeanor larceny. Davis was sentenced to 16 to 20 months in prison and was ordered to pay restitution of $240 to the victim in the cases.

            -- Rodolfo Velino Gonzalez, 28, of Walnut Street in Marion pleaded guilty to driving while license revoked, possession with intent to sell and deliver a Schedule II controlled substance and felony possession of a Schedule II controlled substance. Gonzalez was given 120-day, eight- to 10-month and six- to eight-month consecutive suspended sentences and was placed on supervised probation for 36 months. He was ordered to spend nine months on intensive supervised probation, perform 72 hours of community service and pay court costs, a $500 fine and restitution of $375 for a court-appointed attorney.

            -- Jack Eugene Holt Jr., 48, of Kids Way in Marion pleaded guilty to injury to personal property and injury to real property. He was given a 45-day suspended sentence and was placed on unsupervised probation for 12 months. Holt must pay court costs and restitution of $375 for a court-appointed attorney.

            -- Joshua Ray Hughes, 18, of Morganton pleaded guilty to attempting to obtain property by false pretense. Judge Bridges gave him a six- to eight-month suspended sentence and placed him on supervised probation for 36 months. He was ordered to spend nine months on intensive supervised probation, perform 72 hours of community service and pay court costs, restitution of $500 to the victim in the case and reimbursement of $450 for a court-appointed attorney.

            -- Wayne Gilbert Lassiter, 43, of Justice Road in Marion pleaded guilty to felony breaking and entering and felony larceny. The judge sentenced him to 18 to 22 months in prison and ordered him to pay restitution of $3,180 to the victim in the cases.

            --Tony Andrew Parker, 40, of Garden Creek Road in Marion pleaded guilty to habitual impaired driving and driving while license revoked. On the DWI charge, he was sentenced to 15 to 18 months in prison. On the DWLR offense, he was given a 120-day active sentence.

            -- Benjamin Cody Perkins, 18, of Maple Avenue in Marion pleaded guilty to two counts of a crime against nature. The judge handed Perkins two four- to six-month suspended sentences and placed him on supervised probation for 24 months. He must pay court costs and restitution of $675 for a court-appointed attorney.

            -- Chue Feng Xiong, 26, of N.C. 226 South in Nebo pleaded guilty to common law forgery. Judge Bridges gave Xiong a 45-day suspended sentence with 12 months of unsupervised probation. The defendant was ordered to pay court costs, a $100 fine and restitution of $350 for a court-appointed attorney.

            -- Calvin Ray Washington, 23, of West Grayson Street in Marion pleaded guilty to felony breaking and entering, felony larceny, possession of stolen goods and fleeing to elude arrest. The judge handed him two consecutive six- to eight-month suspended sentences and placed him on supervised probation for 24 months. Washington must spend six months on intensive supervised probation, perform 72 hours of community service and pay court costs, restitution of $2,680 to the victims in the cases and reimbursement of $450 for a court-appointed attorney.
