A judge sent a Rutherford County defendant to prison for his role in robbing an elderly McDowell man two years ago.
Steven Brent Mooney, 24, of Rutherfordton pleaded guilty in McDowell County Superior Court to felony larceny. Judge James W. Morgan sentenced him to nine to 11 months in prison.
He was originally charged with common law robbery, but prosecutors allowed him to admit to the lesser charge as part of a plea agreement.
On Jan. 28, 2010, Garmon Patton, 87, of Nebo gave Mooney and 21-year-old Roy Steven Buff of Bostic a ride to a convenience store. Detective Andy Manis of the McDowell County Sheriff’s Office said Patton did not know the two suspects.
At the intersection of N.C. 226 South and Gaddy Road, the men demanded money from the victim, so he handed over $2 in change, according to the detective. The suspects got out of the car and fled on foot.
A citizen’s tip led authorities to the culprits.
Buff previously pleaded guilty in Superior Court to felony larceny and was sentenced to six to eight months in prison.
